In these general terms and conditions, the following terms shall have the following meanings:
a) Trader: LUNA ECOM LIMITED, registered office: Unit 2A, 17/F Glenealy Tower, No.1 Glenealy Central, Hong Kong.
b) Consumer: A natural person not acting for purposes related to their commercial, business, craft, or professional activity.
Article 2 – Trader Identity
Registered business activity: Retail trade of cosmetics and personal care products
Email address: info@lepilonskincare.com
Article 3 – Scope of Application
These general terms and conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer.
Article 4 – The Offer
If an offer is time-limited or subject to certain conditions, this will be explicitly stated in the offer.
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and meets the applicable conditions.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the purchase contract of a product within a cooling-off period of at least 14 days, without stating any reason. The trader may ask the consumer for the reason of withdrawal but cannot require it.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, they will only be responsible for the return shipping costs. If the consumer has already made a payment, the trader will refund the amount as soon as possible and no later than 14 days after the withdrawal.
Article 8 – Prices
Notwithstanding the previous paragraph, a professional may offer products or services at variable prices when those prices are subject to fluctuations in the financial markets beyond the trader’s control.
This link to fluctuations and the indicative nature of the prices must be clearly stated in the offer. Price increases within three months of the contract being concluded are only allowed if required by law or regulations.
Price increases more than three months after the conclusion of the contract are only permitted if agreed to by the trader and:
– if they are based on statutory or regulatory provisions, or
– if the consumer has the right to terminate the contract when the price increase takes effect.
The place of delivery is the country where the shipment begins. In this case, delivery occurs outside the EU, and the postal or courier company will charge the customer VAT and/or import clearance fees. Therefore, the retailer does not charge VAT.
Article 9 – Conformity and Warranty
The trader guarantees that the products and/or services comply with the contract, the specifications stated in the offer, reasonable expectations regarding functionality and reliability, and the legal and regulatory provisions in effect on the date of the contract’s conclusion.
Article 10 – Delivery and Execution
The trader will exercise the utmost care in receiving and fulfilling product orders and in assessing requests for the provision of services.
Article 11 – Duration, Termination, and Renewal of Agreements
Consumers may terminate indefinite contracts for the regular supply of products (including electricity) or services at any time, subject to the termination rules agreed for that purpose.
Article 12 – Payment
Payment must be made within 14 days from the start of the cooling-off period or, if there is no cooling-off period, within 14 days of concluding the contract. In the case of a service contract, this period begins on the day the consumer receives confirmation of the contract.
Article 13 – Complaints Procedure
Complaints regarding the execution of the contract must be submitted to the trader in a complete and clearly described manner within 7 days from the date the consumer became aware of the defect.
Article 14 – Disclaimers
All prices may be subject to typographical or printing errors. We disclaim all responsibility for the consequences of printing errors. In case of a pricing error, the trader is not obliged to deliver the product at the incorrect price.
